UPDATE UPDATE: TMZ is reporting that Taylor Swift probably knew she was being recorded/overheard when Kanye called her, and her lawsuit threat doesn't have much ground.
Apparently, the California law which Tay's team was referencing specifies that recording a "confidential communication"--aka telling the person it's just the two of you--is where you can slap on a nice suit; when a convo is simply "overheard," the same rule doesn't apply.
It seems unlikely that Swift would assume she was speaking to Kanye solo, since they were on speaker phone--especially someone as savvy as Taylor.
She is the FDR of pop music--homegirl knows what's up.
It's illegal to secretly record a phone call in California, and clearly from the tape, Tay was unaware she was on candid camera.
The Swift paaaaaper serve stated:
Demand is hereby made that you immediately destroy all such recordings, provide us of assurance that this has been done, and also assurance that these recordings have not been previously disseminated.

Keeping Up with the Kardashians episode, Kim Kardashian decided to give--sorry GIFT US--with a little behind the scenes footage, regarding her husband Kanye West's controversial "Famous" lyric involving Taylor Swift.
If you remember,
Kim told GQ that Yeezy meticulously recorded every facet of progress on The Life of Pablo, including the alleged phone conversation between him and Taylor Swift, where TayTay gave her blessing on the reference.
REFRESHER: "I feel like me and Taylor might still have sex/Why? I made that bitch famous."
As we know, Taylor went on a sequel crusade for sympathy in the wake of TLOP's release, including this impassioned Grammys speech, where she seemingly called out West.
Swift even went as far as denying Kim's claim, and saying KK was "under pressure" by her husband, and confused.
